Offenburg, 31 May, 2016 – Today MEDICLIN Aktiengesellschaft (MediClin) filed a lawsuit in the district court Offenburg, to put forwards claims regarding repayment of above market-based paid rents. For the period of 2005 to 2015 the Company assumes that the paid rent in total was above the market-based rate.
The lawsuit is directed against existing and former shareholders of the Company, who are shareholders of the real estate fund, in which the acquired and leased-back clinics were pooled between 1999 and 2001.
Considered the chances and risks of the lawsuit, MediClin has taken into account that subject of this lawsuit will be − especially the evaluation of the customariness of the respective rent − a complex issue and difficult legal aspects partly judicially by the Supreme Court not yet answered.
