Ad hoc announcement: Claims in connection with the sale of limited partnership interests to MediClin AG

Frankfurt, 10 February 2005 - In the context of the closing of the takeover of the Hurrle Group by MediClin AG former limited partners of Hurrle Klinikgruppe acquired by MediClin AG in 1998 have asserted claims in connection with the sale of their limited partnership interests to MediClin AG.

One limited partner had asserted his claims in court; however, the court of first instance only decided in his favor with regard to a part of his claims. This proceeding is currently pending at the appellate level.

In order to interrupt the period of limitation a total of 236 additional plaintiffs have filed suit in the meantime. The claims asserted with these additional suits and the proceeding already pending amount to a total of Euro 18.67 million plus interest. When filing their suits, the additional plaintiffs simultaneously applied to the court for the order of a stay of proceedings. The court requested MediClin AG to advise whether it agrees to a suspension of the proceedings.

MediClin AG considers the alleged claims unfounded in their entirety and will challenge their assertion. However, the company at all times has set up adequate provisions in its balance sheets.
